Terms of Service

1. Agreement to Terms

By accessing or using SwipePicks, operated by 1001487045 Ontario Inc. ("the App," "Service," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the App.

We reserve the right to modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the modified Terms.

2. Eligibility

To use SwipePicks, you must:

• Be at least 19 years of age (or the legal age in your jurisdiction)
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the App under applicable laws
• Provide accurate and complete registration information

By using the App, you represent and warrant that you meet all eligibility requirements.

3. Description of Service

SwipePicks provides:

• Sports Betting Information: Aggregated odds, statistics, and analysis from third-party sources
• AI-Powered Insights: Machine-generated analysis and confidence scores for educational purposes
• Pick Tracking: Tools to save and organize betting information
• Community Statistics: Anonymized, aggregated data about user preferences

4. User Accounts

4.1 Account Creation

To access certain features, you must create an account by providing a valid email address and password. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

4.2 Auto-Generated Usernames

We automatically generate usernames for privacy and safety. You may not attempt to impersonate others or use misleading identifiers.

4.3 Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms, without prior notice.

5. Acceptable Use

You agree NOT to:

• Use the App for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the App's functionality
• Scrape, harvest, or collect user data without authorization
• Use automated systems (bots, scrapers) to access the App
• Reverse engineer, decompile, or disassemble the App
• Transmit malware, viruses, or harmful code
• Harass, abuse, or harm other users
• Use the App to promote unauthorized gambling services

6. Intellectual Property

All content, features, and functionality of SwipePicks—including but not limited to text, graphics, logos, icons, images, software, and the overall design—are owned by SwipePicks and protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

7. Third-Party Content and Links

The App may display content from third-party sources (e.g., odds data, sports statistics). We do not control or guarantee the accuracy of third-party content and are not responsible for any errors or omissions.

Links to third-party websites or services are provided for convenience only. We do not endorse and are not responsible for the content or practices of linked sites.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We specifically disclaim warranties regarding:

• Accuracy, reliability, or completeness of any information
• Uninterrupted or error-free operation
• Fitness for a particular purpose
• The outcome of any betting decisions made based on App content

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWIPEPICKS AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or other intangible losses
• Damages arising from your use or inability to use the App
• Any financial losses from betting decisions made using App information
• Unauthorized access to or alteration of your data

Our total liability for any claims shall not exceed the amount you paid to us (if any) in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless SwipePicks and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Any betting or gambling activities you engage in

11. Responsible Gambling

While SwipePicks does not facilitate gambling, we encourage responsible behavior:

• Only bet what you can afford to lose
• Set limits on time and money spent
• Recognize signs of problem gambling
• Seek help if gambling becomes problematic

12. Governing Law and Disputes

These Terms shall be governed by the laws of Ontario, Canada, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the App shall be resolved through:

1. Informal Resolution: Contact us first at legal@swipepicks.app to attempt resolution
2. Binding Arbitration: If informal resolution fails, disputes will be resolved through binding arbitration in Toronto, Ontario

You waive any right to participate in class action lawsuits or class-wide arbitration.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SwipePicks regarding your use of the App.
